14 Pro Max keeps showing the restore screen

Anyone else getting the “restore screen” on 14 Pro Max? The phone arrived with a black screen with apple logo and wouldn’t switch to the hello screen. I plugged it in and it showed the restore screen. I tapped left up/down buttons then held the right button and the hello screen finally appeared. The data transfer went fine, but the next day I got the restore screen again. I’ve been in touch with apple care to return it and they said to give it 24 hours. It was fine for 4 days, then I woke this am to the restore screen. Back to AppleCare. They ran a diagnostic and said it’s not a hardware problem, it’s a software problem. I have an appt to speak to a supervisor today. I just updated to 16.02 and the restore screen came up again during that process. Any thoughts?
