i bought a 160GB ipod earlier this year and i purchased applecare. go figure, apple discontinued this product and is only producing 120GB classics. my ipod hasn't been responsive lately, but i'm afraid of sending it in and having them replace my 160GB with a 120GB when i paid for a 160GB and i have about 140GB used on this ipod. will apple REALLY give me a (new) 120GB, or will they try to give me a refurbished 160GB?

You will still be given a 160GB Classic but it will likely be a refurbished unit as your warranty clearly states.
 
If you have AppleCare on it, they will not give you less than what you purchased.

Period.
