I understand that If my iphone 3gs is on 3.1 and not already JB that it is currently not possible to unlock the phone do to the baseband. Is this really unlockable now or will some hacker eventually figure out a way to do it.

Wouldn't it be un-unlockable what you are trying to say hehe? It will be figured out eventually. There are always holes. However it may take long, or be ready this week.
 
You have to be on 3.0/3.0.1 and use Pwnage to update to 3.1 to maintain the 3.0 baseband.

If you've already updated to 3.1, you can't Jailbreak or Unlock.

It may get figured out in the future. For the foreseeable future, it cannot be unlocked.
