iPod 5.5g iPod just unresposive

I have 5.5g iPod and I just wanted some advice as to what be the problem with it. The iPod functions properly, but sometimes when it has been off for a while and I go to play a song it just sits there on 0:00 seconds. I can hear the faint click of the hard drive like it's searching for the song, and I can still navigate around the menu, but songs just won't play. Is this a bad iPod? Should I send it back (it's 7 months old, I got it discounted with my MBP in August)?
