As discussed before, it's pretty unlikely that the FCC would have signed off on there being an unactivated 3G system in the phone without it being publicly documented -- meaning if it were there, we would know about it. The situation is not an analog to the 802.11g/n situation, because unlike that situation, different spectrum and licenses are used. The government has to, as far as I know, specifically clear the device with respect to each long-range wireless technology it uses.
