Air Late 2008 battery vs Mid 2009 battery

hi, i have a quick question for you guy. (i searched the forum but couldn't find the answer)

I have a Late 2008 air and i need to change the battery, can i buy the mid 2009s battery ?

Mid 2009 battery : 40 Wh
Late 2008 battery: 37 Wh

I just upgraded my late 2008 with the 40w battery.
Works fine. It's been about two weeks.
