I noticed tonight when the new TOS from iTunes 9 when buying apps, the first time you get the new TOS; and it clearly states "All sales final, no refunds"

Is this new? Seems like they don't like giving back money.
 
Pretty much ever since Apple released their store.

Hmm.. never noticed it before, but maybe they just adjusted the spacing so that it is easier to notice. But I have read on here that some people have gotten their money back for things like Navigon and TomTom.... right??
 
It's not a new Term. It was quoted to me by Apple last year when I asked for (and got) a refund. I think they have it there as a first point of refusal but will waive it in certain circumstances. The trick is getting to be a "certain circumstance" ;)

It actually works quite well with the Kindle app.

A couple days ago, I mistakenly bought Book A while meaning to buy Book B. Didn't realize this til the Book A showed up in the list of books (and already on the phone). Called Amazon Kindle CS, and they refunded my $, and then the next time I opened the Kindle app, the downloaded book no longer was there.

It makes sense in that the consumer has no responsibility to care if it is possible to keep an illegal copy. They are agreeing to destroy all copies as part of the terms. If an app is unable to perform the advertised functionality in a reasonably stable manner, a refund is due.

with itunes you get an .ipa file that you can back up to another location and Apple can't delete it off your computer. you can always add it back to your library. Apple would have to have a blacklist server with every app you ever gave back and build functionality into iTunes to check it. and it would be very easy to block it.
 
Too bad - people should be able to return more expensive apps if they don't function as advertised.

I made this mistake with Gazette and got screwed out of my money. I have used Installous ever since to try out any app more than $1.99. It saved me from the mess that is TomTom and I went ahead and bought Navigon as opposed to buying both. As they say, it is the solution to a flawed store.
 
This is really bad policy. The more Apple tries to control this market, the more I want another phone to come out... Storm 2 maybe?
 
I bought Tom Tom and I don't like it. It's a shame it cost me $99. I sent them a well worded email, explaining my situation, how I'd agree to put the credit towards Navigon, and how I'd show proof that I removed Tom Tom from my iPhone if such method exists. I also mentioned how I have been a long time Apple and iTunes customer and would hope that they could give me the one time good-will, seeing as its $100, and allow me to have the credit. I am very confident they will help me.
 
The problem is many Apps do not work as Advertised. Apple say that they review and approve every Apps description for authenticity. But we all have seen that sometimes sales pitch stretches the truth too much.
 
As far as I am concerned it should be illegal to not issue refunds for crap...

If I hand over money for a program and it doesn't work as advertised I should be able to receive a refund. If the app gets pulled and I lose the support I expect as part of the initial sale I should be able to get a refund.

This policy makes me VERY reluctant to spend money on apps. The more expensive the app the worse this gets...

Overall The app store is my main gripe about this phone.

Got a response, within 5 hours, on a Sunday. No hesitation to refund it at all. She will also submit my complaint about Tom Tom for further investigation as she understands I am not the first person to complain about the quality of the software...being the $99 that it is!

I have also been authorized to keep the software on my device and am welcome to any updates in the Future that Tom Tom may release.

As well, my account will be credited $99+tax within 5 business days and the money is "mine to do with as I wish".

Excellent service from Apple!

damn thats mighty nice of them. yep tomtom = fail

i bitched about navigon @ first but my phone had gps issues i thought it was the app..

but now 1.2 works GREAT

See I saw your other thread on this and I question your purported allowance of keeping the app on yor device and your eligibility of future update. I find this wrong. I think refunds should be considered, but how does it not lead to what you did? "Return" an app and claim it's not what you want but yet you'll keep it around anyway; only after a refund? All of that is a big bucket of fail right there.

As for "no returns" I again restate on a case by case. Like in my case, I paid $2 for an app the developer abandoned a month later citing concerns he may be violating some law. I asked for a refund and Apple said it worked when it was available and it's not their issue if it was abandoned.
 
I think they need this to since Beejives 3.0 update has come out and other patches i keep going back and i still get random disconected from server from Aim/Facebook While ive been Using Aim pro and have been loged in for 7days on aim and been Using IM+ for Twitter pushes and Facebook its been great. Has not have any disconection issues from IM
 
Going off on a tangent here, a little, but another thing that bothers me about the whole process is that the way it is setup you are quite discouraged from buying an app now with promisees from the developer of future updates to add features. I say this not only because if they don't keep their promisees but also because the verification process of applications takes so long that the end user doesn't know if the developer failed to update their application or if the the app is just held up in verification. Sure the developer may say that it is in review, but how do we know? Shouldn't updates fly through the review process, but they don't.

I have a few apps that I got from developers here, that I like, and had great potential; but after 3 or 4 months of no updates, I'm assuming that they are abandoned. I can't then, in good conscious recommend these apps to people. But who knows, maybe just something is keeping it tied up? I have no idea.
