I'm getting a minor annoyance of the (!) mark next to my Apple TV in the iTunes source list after each and every sync, stating that my iPhone ringtones were not copied because they cannot be played by this Apple TV.

I don't see any option in the Apple TV summary to not sync ringtones, so the only way I've been able to get around it is by unchecking the box for that file specifically, but then when I sync my iPhone if I don't remember to recheck it, the iPhone loses my ringtone.

Anyone else having this issue? If so, please do what I did and submit the report to Apple at this link!

Same problem here. I'm living with it, for now. One thing I might try, is to rename the ".m4r" to ".m4a", which is what my non-ITS ringtones are. They still sync fine [with :apple:tv], although these don't have the "stik" data mod (they were installed by the ".m4r">".m4a" trick).
