Apple sent me the package by accident and it's been months since I've got it and no one has asked for it back. If someone needs the upgrade I'll gladly mail it out to them.

I'll take it (I sent a PM) but I figure you could sell it. It has some value.
The law is that if Apple sent it to you it's yours free and clear. You have no obligation to return things mailed to your house that you did not ask for. So I'm pretty sure you do have a good title to the software just as if you bought it.
