I dropped my phone in the river and have to get a new phone. Luckily I had backed up everything to iCloud recently. I am considering getting one w an older iOS to stay jailbroken, however the tech support when I called Apple said I had to upgrade to the latest iOS to restore from my iCloud backup, is this true? If not how do I do this?
 
That all depends on if the phone you get has a lower iOS version than what you had on your phone or not.
If it’s lower it won’t let you install the iCloud backup so will have to update, if it’s the same or higher then installing the iCloud backup should install fine.

Gotcha, that makes sense. Thanks! Is there a loophole where I can download the backup to my PC and then to my new phone?

None that I am aware of. Is there hesitation to upgrade? You were there once (hence iCloud backup being on that version).

I should explain. So my 6S was Jailbroken with 10.2, the backup phone I'm currently using has iOS 8.1.1. I am now trying to decide whether to get another 6S running 10 since it's been out and tweaks are all updated or just buy a 7 or an 8 with the new jailbreak?
 
Unless you are buying a used 6S that has never been updated, you are going to have a hard time finding one on 10.2 I feel like. All the new ones from Apple will ship with at least iOS 11. Same goes for a 7 and especially an 8.
