Does Apple TV in the UK have movie rentals? I can see no reference to it on their site?

If not, is this likely to be made available soon? Also can you upgrade the 40gb model to the new software (ie is take 1 the same thing). Sorry bit of a novice with all this.

Maybe. Hard to tell. Even Apple Store employees don't know until the public announcement.

The hardware is the same. Yes, you can upgrade an existing AppleTV to the new "Take 2" software/firmware.
