As much as I disagree the current length of copyright in the US, Avara still does fall under copyright. And any sort of abandonware claim won't work when you can still download the game and buy it from Ambrosia SW. It may be old, but claiming that Ambrosia doesn't support it anymore doesn't seem to fly.
But there is also the issue of patents and trademarks. I don't think patents apply, but trademarks certainly could.
Go ahead and clone Avara, just do it your own way and make it yours rather than copying the game down to a 'T'. That or at least get Ambrosia's permission first before getting too deep into this. Doing things like this is the case where it is better to ask permission than forgiveness.
It's kind of depressing when I think about it. I'm mainly doing this for demo-reel work, and for the Avara community. As to the IP, I honestly don't know how I should ask..
