Official sequel? If it is official, I would like a link. Otherwise I will wait until the inevitable 'please stop, we'd like to keep the lawyers on their leash' letter comes from Ambrosia SW.
 
No, this is not official, and I have yet to receive letters from Ambrosia; why would they care anyways? They've abandoned the game except for the forums and web board and file download.
 
Just because they haven't produced a sequel or updated version doesn't mean they won't politely ask you to stop using their IP. Who knows what the reason is for the lack of a sequel is (anything from code being unavailable, the original author might still have say in any sequel, etc).

Not that I want to dissuade you from such a goal, as we do lack a nice Avara replacement on the platform. However, I wouldn't try to clone Avara and use the Avara name. Make it your own rather than hanging on an existing intellectual property and you could still easily rekindle the Avara fan base.

I've also considered looking at trying to develop a game in the vein of Avara, but I wouldn't dream of using their IP to promote my efforts, it needs to stand on its own.
 
Although I understand most of your post, I do not understand your use of IP, as, of my understanding, IP means Internet Protocol.
 
Dude he means 'Intellectual Property', probably not the best example but think about SNES games. Nintendo still retains the copyright for Super Mario Bros. even though the original is over ten years old. I'm guessing the same goes for Avara.
 
As much as I disagree the current length of copyright in the US, Avara still does fall under copyright. And any sort of abandonware claim won't work when you can still download the game and buy it from Ambrosia SW. It may be old, but claiming that Ambrosia doesn't support it anymore doesn't seem to fly.

But there is also the issue of patents and trademarks. I don't think patents apply, but trademarks certainly could.

Go ahead and clone Avara, just do it your own way and make it yours rather than copying the game down to a 'T'. That or at least get Ambrosia's permission first before getting too deep into this. Doing things like this is the case where it is better to ask permission than forgiveness.

It's kind of depressing when I think about it. I'm mainly doing this for demo-reel work, and for the Avara community. As to the IP, I honestly don't know how I should ask..
