I went to use it and the left side had no sound so I put them in the charger. The left side was 9% and the right side was 100%. The left side is charging up pretty fast though in the case. Has anyone run into this problem and what happens if you bring it into The Apple Store - do they replace one of them or replace the battery?

You sure it's draining fast, or failed to charge in the first place? My right side bud often fails to charge and won't work when I go to use them. It's because it fails to make contact with the pins in the case. I just reseat the bud and in about 5 minutes it's back up to about 40% or so. I recall the bud won't work below 10%. There's no best way to ensure this isn't happening other than to check the charge progress a few minutes after putting them in the case. They charge real fast so you'll see if it's charging or not real soon. The problem for me as I see it is the aftermarket tips I use don't allow the bud to sit in the case fully. For me it's always been the right one.

I think that it wasn't charging. I cleaned the contacts on the earpiece and the charger and that solved the problem. I just used a dry paper towel and that was good enough.

I've thought about using aftermarket tips as I have collected a large number of different kinds using wireless headsets since 2008. Anything larger, as you say, doesn't fit well.
