So i bought a brand new S5 from Swappa. The guy purchased it with a new postpaid account (2 year agreement). He is sending the receipt for the device with the phone. He said it wasn't purchased through Next and said he will cancel the account and settle up the early termination fee with AT&T once I am using the device. How do i know this will not become blacklisted? Did I make a mistake here? Any tips or pointers on what I should do to protect myself since the deal has already gone down? :confused:

There is a little risk here that he will not follow through with the promises....BUT it you paid through PayPal....you can always go through them to get a refund. That is the beauty of Swappa and PayPal. They will help the buyer in case of a problem.

Yeah but unfortunately paypal only protects for 40 days, right?

You can always call AT&T and ask.....They will never give account information. But you can explain the situation to them. The ask only if the guy was current on his bill. Tell them you are afraid they will not pay the bill then you bill stuck will a blacklisted phone. they maybe able to help with a little info at least.
I don't know how long the PayPal protections are after the sale......

From what I've been told, there are only three ways a phone can be blacklisted.

1) It was purchased on an installment plan that wasn't paid. (Next)
2) It is active on a postpaid plan that wasn't paid. (Contract)
3) It was requested by the account manager, because it was stolen.

In the first case, you would be in trouble. It would very likely be blacklisted.

In the second case, only devices that are active on the account in question at the time of nonpayment will be blacklisted. So, for example, if you activate the phone on your account and the original owner doesn't pay his bill, then you're fine, because it would blacklist only whatever devices were active on his account, and the phone is on your account now and not his.

In the third case, I believe you can only report a phone as stolen if it is active on your account. So, that shouldn't be an issue.

If it isn't currently blacklisted, and you are able to activate it on your account, then you won't have anything to worry about. You could call AT&T and ask for clarification, though, so you feel better about it, but you should be safe.

I want to add, the only way this could possibly be a problem for you is if has already reached nonpayment status. In that case, the phone will currently work, but once it reaches the collections stage, they'll disconnect it because it was active on his account at the time of nonpayment. That can be a few months.

Yeah I thought I saw him say he was back to iphone

I did but then I had (another) change of heart. I looked in the mirror and I don't see an iPhone guy anymore. I really think I've gone over to the dark side for good. The positives of the S5 outweigh the negatives and the things I like most about the S5 outweigh what I miss most about the iPhone. :cool:

Seller agreed to refund the payment anyway after I explained my uneasiness. I just went and bought one on my own from AT&T so I'm happy now. :)

bumping this thread. Has at&t updated there current policy, or this statments is still considered accurate in regards to their blacklist or blocked policy???
i think i may have a device i purchased on craigslist that was purchased by the owner under contract (post paid 2 yr subsidized and not At&t NEXT program). i want to make sure i have the accurate policy before i sell the device. thanks any info would be appreciated.

It looks spot on to me. I buy a lot of phones on CL......I always meet at AT&T and ask the rep...... "Is this phone financed?" I explain to them what I am doing and just want to know if I am at risk of the phone being blacklisted if they don't pay their bill.
If they don't want to meet at the carrier store.....i don't buy the phone no matter how good the price is......
