I bought my phone to verizon and they checked out my phone and said im eligible for the warranty because there is no physical damage but they never looked through my phone which is obviously jailbroken.

I sent my phone back to applecare after the new iPhone was recieved and it is jailbroken and very obvious but the broken or defective home button can be in no way related to the jailbreak so will it still void my warranty?

backup, and restore it.
when you get it back you might have a iOS6 device, hope for a iOS6 jailbreak soon.

I sent it out already and everything is jailbroken so they will know theres nothing farther i can do now

they might refuse it, but the hassle of getting your new phone back or getting you to pay for the new phone is probably too much.
 
just have to see what happens. Apple really doesn't care or isn't going to analyze if the jailbreak caused or didn't cause the problem. there are people in the forum that a genus just shrugged there shoulders and serviced there jailbroken device with no problem. I tried once I was told to unjailbreak it and bring it back. Some were refused service altogether. I would guess the same sending it in. it just depends who you get. this is why we always say you are better to restore. they most likely will not repair the home button anyway. they will probably just replace the device. so to quote a line from Zombieland

Also fyi Sprint or most carriers really don't care or even know how to recognize a jb device. I've taking mine to at&t many time most of the time I get wow that cool how you do that. I've even had the store manager asking me how you jailbreak.

this might be a dumb question but they sent me a new phone already and i just sent my original one back to them, if all goes smooth dont i just not hear back from applecare and keep the new device?
