I just got my discount pricing from AT&T and want to go from my 3g to 3gs. If I walk into a store and buy one, can I jailbreak it? Do they upgrade the firmware on their stock or flash them when the customers get them?

The store agreed to let me look at the phone before purchase, what should I look for? I have a friend there. What firmware is 100% breakable?

I have no interest in iphone 4.0.

I they let you look at the serial number on the box without opening it you should be able to figure out what week it was build and if it will have a tethered or untethered jb. I can't remember details on what digits you have to look for. Hope others can explain.
 
you will like the 4g alot better, so i suggest just waiting. the 3g, is almost the same as the 3gs. the 3gs is faster and has the ability to use the compass app...but since you say you dont care...iphone os 3.1.3 cannot be jailbroken, so if they give you that, have fun on stock, or u have 30 days to return it. also if it does come with 3.1.2, you will have a tethered jailbreak. so if you're going to get one, get one fast before the 3.1.3s come in.

its digits 3, 4 and 5. digit number 3 is the year, digit number 4 and 5 are the week number.

You can get a very good idea if your iPhone requires a tethered jailbreak by looking at the 3rd, 4th and 5th numbers in your serial number. If your serial number digits are "939" OR LOWER, you're safe. If you're serial number digits are "940" or HIGHER, you run a high chance that your iPhone will require a tethered jailbreak.

Some people are reporting that they've been able to successfully jailbreak without having a tethered jailbreak with a serial number of 940 and higher. While this is rare, it apparently is happening.

different factories starting add the new bootrom at different times.
 
It's pretty unlikely at this point that you'll find an old bootrom on a brand new 3GS. The thing to really worry about is when they'll start pre-loading 3.1.3.
 
I have a week 42 with the old bootrom guy at work went to the same store two days later got a week 42 as well with the updated bootrom. So it's potluck at best. According to iclarified week 39 on down weeks 40-45 is iffy. Week 45 on up is definite new bootrom.
