Tell Apple that your MBP gets unbearably hot (document the temperature with your *infrared sensor*) and that it is outside allowable range. Stop whining and just return it.

Dells don't suffer this problem and apple should step up their manufacturing practices to put less amount of grease on so that the fans actually operate. 1: My MBP isn't any "hotter" than the 15" last-generation PB that it replaced, which (under a heavy CPU load) got hot enough to be uncomfortable on my lap. Don't know what this says about the thermal paste, unless it was a problem on the last batch of PowerBooks as well.

2: I can show you a dual-core Dell Inspiron laptop that's just as uncomfortable (heat wise), which is pretty impressive considering it's made of plastic.

3: The surface of the computer in the region of the keys and palm rests don't get hot, much less uncomfortably hot, on my MBP -- it's the underside (specifically, top middle) and the area above the function keys that are hot.

No judge in their right mind would see this through. I'm appalled that you would even waste a courts time, being how clogged the systems are. What on earth makes you think a DUO CORE notebook computer is going to be cool? I, for one, am impressed that these computers came out as good as they did. That is no small feat. They aren't meant to be used on your lap, any yahtzel can read a fracking webpage and see what Apple says about it. Take the blame on yourself for being lazy about it, instead of trying to cash in on someone elses back.

Actually, no lawyer in their right mind would see this through. The bus driver who would drive you to the courthouse wouldn't even see this through...

Because the Core Duo is a notebook processor?

If the top of the computer is hot to the touch (ie, where you're supposed to put your hands), then there's a problem. Apple should fix it. The OP should take it to the Apple store and, if the "Geniuses" isn't on their high horse, everthing should be fine. Just keep track of the temp measurments.
 
The MacBook Pros do run rather warm, but much of the heat is caused by the
Video Card.

I would install Temperature Monitor to see what temperatures are running.

The notes at Temperature Monitor said that the video card in the last 15" PowerBooks were running as high at 100C and that was consider the top of the acceptable range.

I imagine the 128 MB and 256 MB VRAM cards are running at about the same temp in the MacBook Pro.

you wanted some "advice" and I believe you have gotten plenty here.

You can not sue for your "problem".

No one here will agree with any of your "conclusions". Which after reading all your posts here, I fail to find any solid ones.

Apple has no legal right to anything you claim because their legal team has got it covered with what is written in the manual.

Documentation that accompanies a product, and contains warranty info etc, whether read or not, still counts.

The Core Duo is not a "low power" processor, but the nature of the CPU is mostly irrelevant, as it tends to be the video card, hard drive, battery, and sometimes RAM that account for most of the heat produced.

There's only a problem if this particular computer is substantially hotter than its peers. Even if it is, there are no grounds for any kind of legal action whatsoever.
 
I just couldn't keep away from this thread ... ah well.

My Dell D810 gets uncomfortably hot - I mean so hot I can't place my hand on the bottom of it for more than a couple of seconds. No serious burns, no sizzling flesh, but I can't use it on my lap or hold it except with two hands on the sides.

I have no figures on how hot it is, but I'm the one in my family who, when washing dishes by hand, doesn't add any cold water.

None of the MBPs I've touched in any store have come close. And this Dell is made of plastic, single core, and 1.5" thick and its fans are on all the time.

Maybe I should sue Dell and my employer.

That's the best thing to do with a defective apple purchase. If there's a problem with your unit, they'll even waive the restocking fee.

Doubt you'll have any legal recourse beyond having apple fix it. FYI, my dell has a warning sticker not to use it on bare skin because it can burn you.

You'd probably only have a case if you actually suffered a burn injury from touching the computer. Has ANYONE reported that happening?

You'd have to be visibly burned to have a case...anything hot enough to leave a mark is going to damage parts of the computer as well (and you'd have to demonstrate that it was a problem with the computer that caused the overheating and subsequent burn), and anything short of that is covered by Apple's user manual statements about using the notebook only on hard, flat surfaces.

The problem you have is that you will be unable to obtain any form of legal aid, because when making an application for legal aid, there is a question asking what measures you have taken so far to reach a solution prior to litigation.

Your answer to that would have to be none.

Alternatively, as you appear insistent in pursuing Apple on this, you could contact Trading Standards, and discuss the problems and your concerns with them. But again, you'll encounter a similar problem as above, they will ask you if you've given them an opportunity to repair your product, to which your answer would have to be no.

It's unreasonable to consider legal action against a company for an allegedly faulty product, when you are unwilling to allow the manufacturer the opportunity to examine and repair the machine.

someone posts a topic, people reply to said topic. almost all the replies past the first have only to do with what was said previous, NOT all the way back to the original post.
