I am trying to replace my 2G iphone with a new iphone 3Gs without jailbreaking it, as well as trying to minimize cost. I currently have an iphone 2G without data plan and was wondering if I could purchase a new 3Gs and cancel the contract within 30 days but in the mean time switch the sim card from the old 2G to the new 3Gs so I could use my current phone # and phone plan from my old 2G on a new 3Gs. This plan is probably flawed so I was wondering if there is a better way to get a new 3Gs without having to jailbreak it. Any input is greatly appreciated. Thanks!

Can the sim card from 2G be swapped with 3GS ?

If it's an AT&T sim, it should work without JB. If it's any other, you will need to JB.
Its definitely an AT&T sim, from my old 2G iphone that is now on a $29.99/month family plan (no data). I am new at this so I have to ask is all I have to do to upgrade my 2G to a 3Gs is swap sim cards ?
I have swapped AT&T sim cards in and out of several iPhones (3G and 3GS). If the phone fires up so you can make a call, you are good to go.

Otherwise if you purchase the 3GS from AT&T or Apple, you will have to sign a contract. Now you can terminate the contract after 30 days and pay the ETF, but then I believe you will lose your phone number since it's not being ported anywhere and AT&T will no longer consider you a customer.

Yes, but he can just get a new phone number from AT&T when buying the phone, then switch the sim and don't use the new sim.

I am already on an AT&T contract though through my family plan so technically as long as I don't cancel this contract I won't lose my number. The only contract I would be canceling would be the second contract under the 3GS and the number for that phone would be null but, I don't want to keep that anyways I want to just have my current family plan contract only with a new 3GS iphone.
Ah, in that case it's like you are buying a 2nd line since you are under a family plan? If so, couldn't you just buy the iPhone for the no contract price? That would eliminate the need to wait 30 days and then having to pay teh ETF, you could just do it all in one process.

Isn't the no contract price higher than the buy with contract, pay one month and pay ETF or $175.

I think it's about $56 difference ($299 + $175 + $70 + 30days wait and follow up with AT&T to cancel = $544 + 30days wait and follow up with AT&T to cancel), but how much is your time worth?
