can two apps have a same name in appstore?
I want to develop a app but that name has been taken already by somebody. Can i use the same name and publish an application?

Yes, search "Units". I wouldn't recommend it though, people might associate your great app with their bad app and you don't want to do marketing just to have them search the store and download their app.

Do you really want someone else's app with the same name as yours? Better to be unique. If someone has got there before you...bad luck...pick another name.

This is YOUR app, (hopefully) it's special to you. Give it your best shot.

You need to consult an attorney. There may be copyright/trademark issues associated with taking the name of somebody else's property that is already in commercial use. I am not a lawyer, but I gotta love them for just this purpose.

Best non-professional advice: change the name of your app.

Try http://www.uspto.gov before you commit to a design for your stationary. They love and cooperate with everyone in the whole wide world.

You can't copyright a name, but you can trademark it.

There are also lots of generic names that cannot be trademarked, or have lost their trademark due to generic use. It's unlikely that someone can trademark a calculator called "Calculator" (which was probably a job title before the industrial revolution).

But if it is trademarked, it can still be used as long as your apps aren't in the same genre, right? I'm thinking back to all the apple records and apple computers stuff, it wasn't a case for the judge until apple broke into music.

Yes, my game, Linx, has the same name as another game, but they are quite different.

I may have to change the name of my app in future to differentiate it, but we'll see.
