No, they don't claim to have any inside knowledge...

Kuni BMW in Portland, Oregon is having a contest to win an Apple Tablet. You have to sign up for their mailing list to enter, the winner will be determined in March. They use the iNetbook rendering as their photo.

In a response on their Facebook page, someone with the dealership states that they have no inside knowledge, they are just taking advantage of the hooplah, and assuming that all the rumors are true.

Nice. On the "Fill Out an Entry" page, they have the iNetbook image, without the copyright, and their own logo on top of it (nice case of stealing someone elses work). Plus the fact they are guaranteeing something that hasn't even been released, let alone confirmed. Way to go Kuni BMW. I wonder if this is how they do stuff online, then how do they manage their customers? Nice business model.

Yeah, I may not be able to afford a BMW, but if I did, I'd use their major local competitor, Rasmussen BMW. (I know two people who bought Beemers during the dot com boom, one bought from each dealer, the one who bought from Kuni wasn't happy...)

Other business are doing the same thing (there's an app vendor over in the app codes thread) offering up entries in a win a tablet contest. We'll see lots of it in the week to come.

Corrected the image credit

Hello! --We did add the image credit to this shortly after starting the giveaway promotion, after mistakenly leaving it out. We do respect the artist and want to give proper credit.
We do also take customer service very seriously. BMW is soon to announce the top-rated dealerships in the nation for customer service and operational excellence, and it looks like we are going to be rated #1 out of 360 dealers. So hopefully you will give us a try sometime if you are considering a vehicle.

Enough of that...this is a Mac forum after all! I absolutely LOVE the products and am a subscriber to MacRumors news feed!

I'd be happy to answer any questions about our Apple Tablet giveaway too.
Thank you!

Oh look, yet another business who has to justify themselves on a forum. Btw, you still havent corrected the image, I have the signup email with proof. Also, how can you make this promotion/contest when the prize hasnt even been released or confirmed? Explain that one.

That's easy, they say, it will be delivered when it is released. Nothing more, nothing less. If it is NEVER released, guess what, they don't need to ship anything.

I don't see a problem with them doing this, that is their choice, and the end users choice as well, if they don't like the terms, don't enter.

Kuni, can I haz tablet please? And, FWIW, I'm considering a new BMW for my next car -- if I win and I chose to go BMW can you ship the car to California? :D

Even if you added the credit, it's not a free image. You should contact the artist and request a license to use the artwork. Anything less is copyright infringement.

FYI: We have approval

As I mentioned previously, respecting the artist's work is important to us. I contacted the artist, and have received approval for use of the image.

"Crediting is ok, a link back to the flickr page would be awesome,
Thanks, ps where can i see this?"

We admittedly made a mistake in our initial posting by not obtaining permission first.

This is just a transparent aknowledgement of our desire to do the right thing now and in the future.
Thanks for the MacRumors community for input.

Well if the tablet doesnt get released, im sorry but thats just bad for business. I mean think, they are a BMW dealer, so saying that theyre giving away the tablet and lo and behold it doesnt happen, just think what they do with their cars.

asking permission to use someones image and deleting their copyright and placing your own image on top of their image, then linking back to it are completely different. Its still copyright infringement. Put the original image with the owners copyright back up.

I think everyone knows that Apple is revealing a tablet tomorrow.

The owner didn't watermark their photo. The artist has seen our use and has approved it.
