I know the jailbreak does not allow ios updates from the phone. When I go to settings mine says checking for update with the spinning wheel. Is this a draw on the battery? Anyway to get it to stop?

yeah i am also facing the same situation!
 
The evasi0n jailbreak disabled OTA updates.
This is by design (connection blocked to OTA update server)
Nothing is wrong with your phones.
Every phone with the evasi0n jailbreak does this exact same thing.
 
I understand its been disabled. I never noticed the spinning wheel before. I thought if it kept continually trying to check, it may be a battery drain.
