When I right click the Finder icon in the Dock, the list appears of all the active Finder windows above.

When I click one in the list, the Finder window appears - then I press the red button to 'close it' - its gone.

But when I right click the the Finder in the dock again - its still on the list, it doesn't close?

When I go - Finder > Finder > Option key Close all - They still appear on the list.

Is this new behaviour? Is this a thing a Monterey, is it a bug?

I'm updating from Lion, where the above issue never happened.

I think you already have your answer, but just to be sure...

That list is not the list of open windows; it's the list of recently opened windows, put there for your convenience should you wish to revisit them.

You can modify how many remembered windows are retained in this way. That setting is made in System Preferences > General > Recent Items. You can even set it to "None" if it bothers you to see that list.
