Has anyone had their Debit Card charged for Apple Services- Big Fish gambling Application- and it was NOT YOUR charges. A family member got ahold of my Debit Card and charged $1,500.00 + and APPLE will not reimburse me EVEN though they can see CLEARLY that my family member is the one who STOLE my Debit Account Information. I have never charged anything to this gambling site, never- waste of money and this family member whom I was living with plays 24/7 (addicted??!!). I explained situation to customer service TWICE due to the 1st claim was denied???!!!!! Why I ask the service rep, I don’t know she says, well can I speak to your manager or someone from that area- I get a , I am the highest representative. I said you must report to someone???? She repeated herself like a robot, I am the highest representative. Ok well, I want a refund, I did not make these purchases, as they can clearly see with my history, I get a ,” I am sorry but you were declined and I cannot tell you why! WHAT!!!???!!?! And I cannot speak to ANYONE , she’s the highest representative! I guess she reports to NO- ONE, therefore, her yearly reviews must be outstanding!!!???!?! I am so upset that such a reputable company name would have such a horrific service process and only give you scripted answers, nothing extra and you cannot speak to the management team. This is such a devastating time for me due to COVID-19. I happen to be one of the unlucky ones who was hospitalized for having COVID, lost my job due to the COVID, trying to keep my smile on and be grateful, which I am. When I do work, I work very hard, passionate about what I do and whom I help and what little I make I need. So I get robbed and $ taken freely by Apple and I cannot get my refund- why you and I ask- no idea because I spoke to the HIGHEST REPRESENTATIVE. TIM COOK, IF YOU SEE THIS, PLEASE CONTACT ME AS I WILL BE SENDING YOU A MORE DETAILED EMAIL WITH ALL DATES USED. I REALLY HOPE YOU CAN HELP ME DURING THIS COVID-19 TIME, horrible, horribble. Thank you and I apologize that this was so long, PLEASE HELP Robert P.

Instead of being mad at Apple, you need to press charges against your family member, and then promptly contact your bank informing them of such, so that they can perform their own fraud investigation. And if they do find fraud against you, they may refund the money to your account.

My bank states that Apple should have checks and balances in order to intercept this type of fraud. Why should I LOYAL APPLE CUSTOMER)go thru all this aggravation and time when Apple is the entity who allowed family member to use it. I would say the onus is on Apple NOT Bank of America. I am quite sure my $1,500.00 refund would not bankrupt Apple. As long as Apple can identify who the individual recipient of game coins is / Apple ID. A refund should not be an issue.

I don’t agree. Apple charged my account for no services rendered to ME.

Was your phone locked prior to your family member accessing it? If so, how was this person able to unlock and further access the data on your phone?
Took from wallet

I empathize with your issues, Robert, but customer service is made up of people. Yelling at and being rude to them, even when you’re frustrated, will just make them less sympathetic and willing to help you. Hit the breaks, calm down and think about it rationally for a moment.

Apple does not offer any service named Big Fish Gambling. There is also no Big Fish Gambling on the App Store. Though there is a developer named Big Fish Gaming that makes a variety of different games that they publish through Apple’s storefront, but they are independent from Apple as an entity.

There are very strict rules and regulations on gambling in the App Store, and basically Apple doesn’t allow gambling services or apps on their storefront. Now there are some very specific exceptions to that rule, but it requires a lot of authentication among other things; In Denmark for example we have a nation wide identification system called NemID which is like a 2FA authentication system for everything official and gambling services in general have to use this and social security numbers to let people “play”. The App Store basically enforces similar rules, and even more ontop, worldwide so the App Store really isn’t a place where you see gambling, and neither is the products of Big Fish, legally speaking at least. They have some products based on screenshots and such that you might argue straddles that line, but you can win no money out of the system - they are purely video games with in-app purchases not so different to FarmVille or other gaming products with ephemeral, premium currencies.

To make an In-App purchase, not just does a device need to be unlocked, but your Apple-ID or biometric authentication needs to be performed as well.

There are already quite a few safeguards in place here to prevent abuse of funds.

However, while Apple ultimately can issue refunds on purchases through the App Store, if they refund you in this case you will technically have achieved these expensive “products” from Big FIsh Gaming for free that there is nothing scammy about at all - for all intents and purposes they were legitimate In-App Purchases.

Now if you reach out to Big Fish Gaming and explain their situation, they may be willing to help you tasking with Apple about getting a refund, if they’re willing to let go of the revenue on their end, but Apple has already put in the safeguards, and no foul play has been performed on their end - and the product purchased from your account has nothing really to do with Apple other than being distributed through their storefront, but by a totally separate entity.

I would also highly recommend getting your family member help if they cannot control their spending on a mobile game, to the extend that they effectively steal money from you to fund their addiction.

I sympathize, but the safeguards were there

Listen, federal law protects consumer like yourself against unauthorized charge such as this even by a family without your consent. You need to either contact that family member for reimbursement, file a dispute with your credit card company or police report for fraud. However, if this said family member is an authorized user, you can be held liable and won't be considered as fraudulent charge. It is also your fault for not securing your belonging than blaming Apple.

You mean like having a password on your AppleID and giving you total control over TouchID, FaceID, purchase restrictions, and two factor authentication?

“It already does that”
