Ok so basically I just hooked the 3GS up to my computer and let it and iTunes do their thing...eventually I click restore from previous phone (which was a 3g on 2.1 and jailbroken)

After the restore had completed I unlocked my iPhone to see this...
mail

if you didnt notice...the carrier says "Cortana". This was done using "make it mine" from my previously unlocked 2.1 phone...

also...i have blank spaces which are just safari bookmarks minus any text...(thank god because my safari icon is no where to be found )

stocks&weather is also missing because it was in a folder (which now doesnt exist due to the loss of being jailbroken)

anyways...I have one of the first jailbroken iPhone3GS's!! woo!

You would think, but no. All you have is the settings from your previous iPhone transfered to your new iPhone, in this case the carrier name setting. In short, your iPhone is still jailed but the carrier name is changed.
