Don't all iPhone apps sync to the iPad?

According to Jobs, all iphone apps will work with the iPad (excluding 3g requirements). For some reason, I cannot sync Saisuke Free to my iPad.

As you can see, in the picture, the app is on one of my iPad's pages (lower right). However, it does not show up on my iPad. For syncing, if I check it, and once I have completed the sync, it appears as unchecked and not on the iPad?

Can a developer make it so that it won't sync to a certain device?

others will correct me if I'm wrong, but I believe Saisuke requires iOS 4.x and therefore will not work on an iPad

This is most likely the case, you cannot run apps that require 4.x on iOS 3.x, you will have to wait until Apple updates the iPad to 4.2 in November.
