Previous apps that enabled the Emoji on the non-Japanese iPhones have by and large done it surreptitiously... EmotiFun! (free app) explicitly states that it does so and gives the instructions on how to do so right in app description on iTunes...

Yeah, they don't try to hide it at all.

Yup. The app has definitely been pulled. Someone probably lost their job too for green lighting it.
