It would seem that he will be successful with the lawsuit. The pipe leaking methane is what caused the explosion.

I seem to recall the MythBusters having difficulty in making a port-a-potty do just this.

The problem they had was getting explosion.
This case though there was a natural gas leak which I don't think they tried.
IIRC, natural gas is heavier than air which would allow it to collect in the pit of the toilet which could cause an explosion.
