is it possible to get out of the contract if you complain enough?
I am in new york city, and i cant last longer then 5 minutes on a phone call before it starts cutting in and out... Ive complained a couple of times, they sent me a new sim card, said something stupid about resetting my towers.

But this is ridiculous...has anybody gotten out if they complain enough?

Doubtful, that's what the first two week (or 30 day, depending on carrier) period is for - to assess how phone/carrier functions in your particular area. If you're still within that period I imagine you can get out of the contract but you'd have to return the device per AT&T's policy.

Doubt it. You signed a contract.

But what you can do is file a complaint with the FCC. The FCC recently created an on-line form for this to make it even easier. The carrier is legally obligated to respond to the complaint, so the more people who complain, the better. Do it.

You're assuming it's the network that's causing the issue.

Do you have another phone to test with? If so, pop in your sim... make a few calls to see if the same thing occurs. If it doesn't, drop by your local apple store, tell them what's up and they should replace your phone under warranty.

Its not the phone, its the network. When I had just across the river to Jersey, its fine, or any other city in the US, its fine.
Only in NYC... Well lets see what happens, Ive put in many calls, opened service tickets for them to check my towers...but nothing is working...Its a well known fact that the service is horrible in NY

You sure about that? ;)

And no, you cannot get out of your contact or contract for that matter. Not for the issue you described.

AT&T has even admitted that service is sub-par in NYC and San Francisco, among others.

I would take the advice given about filing a complaint with the FCC.

Another thing you can try. Apple has software available that logs dropped calls.

Get a lot of drop calls in a row then visit an Apple store. Ask, which they may not do, for a log of the dropped calls and then show AT&T. Doubt it'll happen but worth a shot.

Yes, 100% sure. Don't complain to AT&T, that doesn't matter one bit. "Complain" by filing a carrier complaint via the FCC's web site. YES, if you file a complaint using that online form, AT&T is indeed legally obligated to respond. And they WILL respond, since the FCC investigators will be forcing the issue on your behalf. This is one of those very very very rare instances when the government is actually doing something that helps the people.

If this is the case and you were aware of it, surely, it wasn't a wise move on your behalf to invest in a phone from AT&T in the first place? It's always a good plan to check the coverage of the network before signing up.

Based on what the OP wrote, it sounds like he loved in New Jersey before moving, i.e., already had the phone by the time he moved to NY. I could be wrong but that's what I got out of this thread. That and the concept of complaining to ATT won't let you get out of the contract.
