Hello,

I'm sorry if these seem like silly questions. But I'm new and just don't want to mess anything up. I have been searching this forum and on the internet and couldn't find an answer, so I'm probably making it more complicated than it needs to be.

I have an iPhone 5, and my screen shattered yesterday. Instead of spending the money on getting someone to fix it, I'm just going to get the iPhone 5s instead. There's not much left on my contract, so that's the plan.

I am currently running a jailbroken ios 6.1

My questions are:
1. Will the store be able to upload my contacts etc to the new phone if it's in a jailbroken state? If not, what do I do to make that possible?
2. Can I upload all of these myself by backing up my old phone and then transferring it to my new phone?
3. I'm assuming I'll have to jailbreak the phone first in order to upload my jailbroken content onto it (if possible in the first place)
4. does the fact that I'm running iOS 6.1 matter? What version will be standard on the newly purchased phone?

Anyway, if someone has time to maybe give me the step by step process? That would be greatly appreciated for someone - not technically challenged - but cellular-ly challenged. :)

Probably. Will they? Probably not. Jailbreaking voids your warranty. If you don't have a warranty anymore, i.e., you don't have AC+ then Apple has no obligation to you. There have been some cases reported where a Genius will look the other way at a JB iPhone, but you can't count on that.
2. Can I upload all of these myself by backing up my old phone and then transferring it to my new phone?
Yes. Backup to iCloud. Restore the backup on your new phone.
3. I'm assuming I'll have to jailbreak the phone first in order to upload my jailbroken content onto it (if possible in the first place)
Yes. There are tweaks for backup (I use PKGBackup). Make sure your backed up content is stored off the phone so you can access it later. You will note that iOS 7 is the current version of iOS so if that's the OS you get you will probably need to update your tweaks or find new ones.
4. does the fact that I'm running iOS 6.1 matter?
In what way? It's got no bearing on replacing your phone. The only way it might matter is if you get a phone with iOS 7.
What version will be standard on the newly purchased phone?
If you truly intend to get a 5s you will get some version of iOS 7. The iPhone 5c and 5s cannot run any earlier version of iOS.

What version will be standard on the newly purchased phone?

If it is possible and you can get the serial number off the box you can use this web page to see what iOS version the iPhone has but it really does not matter right now because all iOS versions can be jailbroken at the moment.
