I've been ripping all my movies as h.264 but as many people have noted, the new version of handbrake has some problems with audio. Someone on here suggested ripping them as normal mpeg files. I did this for one movie and the audio came through, imported and played on itunes no problem but wont play on aTV

so do i need to change the mpeg encoding settings? or does aTV only accept h.264 content?

Use VisualHub. When I bought my :apple:TV I started off using HandBrake, but had lots of issues with audio cutting out. I switched to VisualHub and it's been great!
