Unfortunately, I had to return the macbook that I got an absolute steal on. It was overheating, and once it go so hot that I could barely touch it, it kernel panicked. I took it back to the store and got my money back.

What I am wondering, is if I should get a refurbished C2D macbook pro off the online store today, or wait until after macworld? I assume they will come out with some new software, but does anyone know if they refurbished laptops will come with the new software once released, or will they contain the original versions?

So you got a "steal" on a laptop and returned it instead of going through the repair channels to get it fixed or replaced by the manufacturer? Not the call I would have made if it's an "absolute steal".

The reason I got a steal on it was because it was an in store demo model. So, it had been there since july. I wasn't sure how long it was overheating, and if that would cause instability problems elsewhere in the future. Starting in a couple of weeks, I am going back to school + working a job on the side. I won't have the time to send it back in the future should more problems have arisen. Also 6 months of AppleCare had already expired.

Also, I paid 1320 + tax for a 15" CD 2.16 with 1 GIG Ram and 100GB 5400 HDD

Is this an Apple retail store? Because if it is your warranty starts from the day you purchased it, not the day it was opened. And I don't believe the MBP would be in repair for a couple of weeks, though you never know. In either case, Macworld is days away, couldn't hurt to wait.

I got it at a CompUSA, if that makes a difference. When I called Apple, at first the lady didn't even want to talk to me because she said I was out of phone support. Then when I explained what was going on, she recommended that I take it back to the store.

Also, any previous experiences from anyone if apple installs new software on refurb systems?

Yea, phone support was probably done, but it still should've had the warranty that would've allowed you to go to an Apple store and have them look at it.

Yet another reason why I never buy anything from CompUSA. Just because it is a floor model is no excuse why you shouldn't get a FULL warranty. I think that would be a lawsuit waiting to happen.

Interestingly enough, CompUSA bundled a 3 year warranty with the macbook, but refused to honor it while it was within their return policy. Really pissed me off.

Get the same problem with Best Buy (Worst Service). Their entire policy is deny, argue, blame, and demean the customer. I wouldn't buy anything that there was ever the remotest chance of needing to return, from either.

The Best Buy harangue is based on family and friend experiences. Nothing that ever needed to be returned, was taken back without a hassle.
