Have To Update for Non Jailbroken MMS?

I know this is probably all over the forums amidst the million mms posts but we've just moved to a new house and things are crazy hectic so I'm kind of being lazy here in new threading this question but here goes...

Do I have to update to this horrendous sounding 3.1 to have legit non-jail broken 3gs MMS working?
