i been stuck on this version foreever nor does my mac have any updates for osx?
 
Cool. Go to App Store, download El Capitan, install. And done.
Don't forget unchecking "receive beta software" in App Store setting.

ok when i go to store and download el captain it tells me i already have it etc still download and install that version?

Exactly. Upon finishing download, installer will start.
Go through all of the process. If everything is all right, you are all set.
If you need, before restarting machine, copy el capitan installer to another location. Then you can use this installer to, say, create bootable media, create install disk, etc.

thanks worked on the new version now i assumed it would have auto updated me or something

Well, if what you are referring to is auto update of system, current version is the latest version.
Maybe, other updates will come out after a while, like new version of iTunes or so.
