how to update prev activated 2g

I'm sure this has been answered before and I apologize in advance for making anyone repeat themselves...but I just haven't been able to find the right combination of search terms to get the answer I'm looking for...

I first bought a 2g phone and then upgraded to a 3g. I still have the 2g device and the sim card that was in it. It currently works (effectively) as an iPod touch since it isn't connected to an active AT&T account -- and this is what I want.

My question is -- how can I upgrade the software on it to 2.1? I would like to continue to use it as an iPod touch but would like to have the latest and greatest software.

You can Jailbreak it and use the "activate" function after you upgrade to 2.1. You can then use as an iPod.

Is there any way to do this legitimately? (yeah, i know i posted this in the hacks forum...) Does Apple support use of iPhone as an iPod touch?
