Alright, here's my situation.

I was running 3.1.2 JB with blackra1n. iPhone 3GS on AT&T model MB717LL with Firmware 05.11.07 and my SHSH logged through cydia. ( I hit the window)

I have been running this build for about a month or so and everything seemed fine. Then this week I noticed the battery draining much faster than usual. I figured it was JB related so I found instructions online and was able to do clean restore (not from backup) and remain 3.1.2 and have not re-jailbroken(yet)

I have seen the battery drain about 1% a minute or faster under normal use with the screen at half brightness and this is much faster than normal.

I have also seen the battery at 43%, pop in the charger, and the battery shoots up to 70 in a matter of seconds.

I feel like this is the small problem that 3.1.3 is supposed to address.

Is there any way for me to go to 3.1.3 and JB?

I doubt the problem is one which couldn't be fixed by just restoring to 3.1.2 and setting up as a new phone. Then re-jailbreak with redsn0w. No need to upgrade to 3.1.3.
 
well I am upgrading to 3.1.3 to see if it helps. I can live without the JB but i will miss backgrounder and kirakae(sp?)

I figured if I am going to have to take it in for warranty I am going to have to put 3.1.3 on it anyway.

It seems pretty foolish not to even try restoring to 3.1.2 to see if it works. It would hurt nothing, and would more than likely fix any problem you have with battery. And your phone would be worth a whole lot more for resale.

Was I unclear in my OP? I DID do a clean restore to 3.1.2 by changing the host file and using my SHSH on file with cydia. And did a full charge depletion and recharge. Still no change in battery performance.

And to be honest, Im not sure if there is anything wrong with the battery. It seems as if the problem is in how the phone meters the battery.
 
Haha, yeah, let us know if you are able to go to an Apple store and jailbreak your phone on the floor model. You should also have someone record it and put it on YouTube.

Unless you are talking about going to the store to just exchange your phone. That'd be a lot less funny.

On a related note, I actually have 3.1.3 on my jailbroken 3GS, and for some reason the battery "fix" that they said was included in the update missed my phone, as seen below. Compare the top right corner's % against the bottom number. I don't really care, since I'm not updating or restoring anytime soon, just something funny :)
