Hi, I bought an i phone a week ago and decided it aint for me. I'm on o2. I went to return it to the store and they said because i had a demo they wont accept it back. The store said contact customer servives. I phoned customer servives and they said contact the store. So i'm wondering now if i can cancel the contract. Any ideas??.

im on at&t but this mite work. u can call and cancel your contract. on at&t u have to have the phone for atleast a month otherwise if u cancel u have to give the phone back too.

Why didn't you try the phone or at least look into it before buying it? What a stupid decision to take out a CONTRACT and then a week later decide you don't like the phone.

Since you're on O2, I'll assume you're in the UK.

If you signed the contract in-store you have no legal rights to cancel the contract and return the phone unfortunately. The best you can hope for is to continue to push O2 (I'd try both customer services and the store) and see if they'll make an exception.

If you bought the phone online then you should be covered under the Distance Selling Regulations. You can look them up online and mention them to O2.

O2 UK iPhone 3G terms of service:

Refer to section 11.1 entitled "Consumer Customers your right to change your mind"

If you purchased the iPhone directly from O2 (and for these purposes, this ought to include any O2-operated brick and mortar store), you have a 14 day grace period during which time you can choose to return the phone and cancel the contract.

This is a clause in a binding contract, and thus O2 must honour it in addition to any statutory rights you may have under regulations such as the Distance Selling Regulations.

Unfortunately, if you purchased the phone from any 3rd party distributor, then this clause in the contract doesn't apply to you.

I bought a payg 3GS and returned it a week later under this clause. Check the terms and conditions on your contract to see what it says about cancelling. (I obviously only checked the payg T&Cs)

I've never heard of a phone company that wouldn't let you cancel your contract (usually within 14 days). Tell them you're not happy with the 3G signal. When I bought mine I asked the guy about 3G and he said I should have good coverage on their post code checker but "a bus driving past could make it go flakey". Probably an exaggeration but nobody said a thing when I returned mine for that reason.

If you bought it from O2 directly then I think they're lying through their teeth at that store and I'd put in a complaint.
