iPhone Icloud account problem

Hi
I bought a second hand iphone in one market place
After it deliverd, i found out there is an icloud account in it with "find my phone" on
When i contact the seller give me the account details to remove it, he didnt answer me
Now i can't do anything with my phone because i dont have password
I searched and i found if i jailbreak it and use ifile to delete account files its possible to add my icloud account on it, is it real?
I whant to know if i do it, my phone will still work?
Because "find my phone is on" im afraid after setting new account because of security things it dont work with any new account
Can anyone help me with this situation?
