You can always upgrade.
The last time around, they let people upgrade who weren't elgible for $399/$499 for the 16gb/32gb. So they gave a slight discount. You sign a contract, so they give you the subsided price because they plan on your data plan paying off the cost of the phone.
When you upgrade, they usually won't subsidize another phone for 18 months (AT&T).
I used the early upgrade option. 32GB 3GS was $499 with new 2 year contract.
Since then I have added the most expensive iPhone plan and my upgrade date is now June 2010.
The more money you give to AT&T every month, the sooner you can upgrade.

i got the 3GS in july and ive been giving them $101.34 a month but my upgrade is Dec 2010, shouldnt it be sooner then?
But one more thing, when you upgrade, does ATT just send you the phone, and you put your sim card into the new iPhone?

Your bill probably includes about $20+ in government and state taxes.
its actually $109.99 before taxes and $133.11 with, but i get a discount from my job and brings it down to $101 so i should be able to upgrade
