After having issues upgrading last night it has completely ruined my files. Restoring the phone to get my apps and pics back didn't work and then after all the set up had finished it made a new backup writing over my old... before the update.. so it backed up a blank phone and now I have lost all my photo's etc... really annoyed

You may have given up, but if you still have energy for it go into iTunes and check Preferences -> Devices. You may have older backups for your iPhone that are usable. Think and breathe first, then delete backups that you know are worthless. Then maybe you'll be able to restore to a good backup.

Sadly I tried this :( it rewrote backups over my one I did before the upgrade... and any previous before that were from 2 months ago. Sucks... ah well
