iPad iPad Pro replacement issue

My iPad Pro replacement Apple Care came scratched And crafts this is my third replacement an apple care don’t want to give me a new unit they set up especially replacement again

why can’t Apple give me a brand new unit even if I covered by any law in the US?

Apple's iPad warranty only specifies a replacement device, not a new device. I imagine that is probably a conversation you have had with the Applecare team already.

It arrived in un-acceptable condition. This same thing happened to me I wont accept replacements mailed to me only accept delivery at the Apple Store where I open it under employee supervision. Also the same thing happened with my Tesla Model Y. Too many panel gaps and crappy paint etc I refused delivery.

I bought a OPen Box OLED at Best Buy they tried to drop it off and Run. I was wait I must inspect before signing acceptance. It was Clearly trashed and non-acceptable. Long story short some Pics to Best Buy CEO. New 55“ LG OLED is delivered at No cost.

U.S. Lemon Law, you get your full money back. Look it up. I know it applies to automobiles since I had a lemon Chevy once. And after 3 major repairs you are given a 100% refund. Not positive if it applies to electronics.

What should I do ?
 
I had an express replacement arrive in worse condition than the IPad i was trying to replace! So I sent the replacement back and decided to wait til the stores re open to swap out my iPad Pro. It is too much of gamble to do anything by mail these days.

The store are closed and my iPad had ghost touching issues they made me return that and keep the broken one
