iPhone 3GS PAYG UK Terms and Conditions (O2)

Just wondering - Does anyone have the T&C from the iPhone 3GS release, to see if there's been any changes when comparing to the website?

I know some people didn't activate their PAYG SIM card when they bought their phone - so where do things sit?
Is the contract length of a PAYG phone 12 months?

which is why I'm interested o see what the exact original terms and conditions were. If there was no mention of being held for 12 months before unlock... Anyhow, third quote from O2 site others from times/ macworld article.

O2's problem?

"Pay Monthly customers
Your iPhone can be unlocked at anytime free of charge. If you unlock your handset and place a non-O2 sim into it, you will still have to honour the remainder of the minimum term on your contract."

As far as I know, there was never been any reference to unlocking whatsoever prior to the interview with the Times and the o2 webpage to which you refer.

I'm not aware there being any specified period of time in relation to the pay and go agreement.

The pay and go agreement is the usual one (not a specific iPhone tariff, I think) so should be the current terms and conditions which were the same in June.

Just wondering what the legality is. (In my case I went to APple, got a PAYG phone, didn't use the PAYG SIM, just popped my contract one in.)

The way I see it, only the handset you got when you signed up for you contract can be unlocked now.

I think a lot of people ar ein this boat with PAYG 3GS' that have original 3G contract sims in them... i know i am.....

I think O2 really need to clarify what happens with this type of situation.

When i bought my 3GS from Apple in the Store they asked if wanted a PAYG sim or if i was going to use an existing O2 sim... i told him i was going to pop my iPhone 3G sim into it and that my wife would use the 3G with her SIMplicity sim.. the store guy then told me there was no need to activate a PAYG sim as it would just be a waste.

So from my point of view i have done nothing to circumvent O2's ability to check when i bought which phone on whatever tariff.

So they need to clarify where people like myself stand in terms of unlock and how exactly they wish to prove when we purchased said handsets.

Yes, it is a bit unclear, I bought a PAYG 3GS a couple of months ago to use on my monthly Simplicity contract, which has been running for 20 months, and I've never activated the PAYG SIM.

Let's hope they base it on your phone number.

I've requested an unlock, so in a couple of weeks time I guess I'll know the answer.

The way I see it, only the handset you got when you signed up for you contract can be unlocked now.

I'm in anim8or's position - I've sold my older handset, to offset the price of the PAYG handset.
Where is the contractual obligation? That's my point - where was it written there wouldn't be an unlock until 12 months had passed? What about refurbished handsets? If you have an unlocked phone, and need a replacement, does the user have to pay again to get it unlocked?

O2's got a fortnight - which is fair enough (they need time in reducing messes of their own making, as does Apple occassionally) - after which it'll seem they're just stalling.

Is it normal to disallow PAYG handsets to be unlocked? I don't mind paying £15, but think it's a bit harsh to lock me down for 6 months longer than my original contract (which will run out before Christmas) just because Igot a new handset.
Apple may come down on this one. I don't really want to shift to Orange, but id' certainly like to have an Orange SIM for Orange Wednesdays, and also if Orange had a better tethering i'd look.
