Like a lot of folks here, I have an iPhone 3G w/2 yr contract, and of course, I want the 3GS, but I don't want to pay $699 or $499, and I'd rather not wait until December to be eligible for a $299 upgrade with a new contract.

So I did some digging and I found AT&T's legalize on their Early Termination Fee, and I quote:

"An Early Termination Fee of $175 may be assessed against you in the event that you terminate your Wireless Service Agreement and/or selected plan before the expiration of its term. For Service activated on or after May 25, 2008, the Early Termination Fee will be reduced by $5.00 for each full month toward your minimum term that you complete."

So if you sat in line early on the morning of July 11th 2008 to get the 3G, you've accrued 11 months of your current contract... So do the math and your ETF is more like $120.

I called AT&T today and confirmed this, and also confirmed that there is no waiting period to sign a new contract (some have mentioned that here), I could literally cancel my contract, pay the ETF, and sign up for a new one in the same phone call. A minor issue is that you will lose your current number as there is a waiting period of 60 days where the phone number must be reserved by AT&T in case you decide to resume your contract... Why they can't simply give you the number if you're signing up for another contract 2 seconds later doesn't make any sense, but hey, that's what AT&T told me.

So... The true cost of "upgrading" to a 32GB iPhone 3GS from an existing iPhone 3G is much less than $499... Plus, don't forget you have an less than a year old iPhone 3G to sell... I'm selling mine for $150, so in my case, ($299+$120)-$150 = $269, not including accessories and apple care, sign-up fees, etc.
 
Sorry but losing my # is in no way going to happen and frankly I believe it is within our right to take our number to any new contract ... whether it is from AT&T to AT&T or elsewhere. I am not 100% on board with this, I see the written terms, but I don't know that it requires a new number.

Nah dude, I just got off the phone with them myself.

You can keep your same number when you restart your account.

ETF 120 + 199 is a hell of a lot better than 599.

lol, att sucks. Even the CS representative thought this was retarted.

good idea, why are you selling your iphone for so cheap? i just sold mine for 380 yesterday

$380?! And I thought the buyer of my $150 3G was a sucker :p... I thought it was fair price considering apple is selling 16GB 3G's for $149.
 
I have a 3G that I bought subsidized which is understandably not eligble for upgrade price till Jan 2010.

BUT!

My girlfriends original iphone is also not eligible till JAn 2010, she never got any discount phone or free phone on that line (nothing). She is just using a old iPhone that was given to here used. Shouldn't she be eligible for discount price?

It depends on when her contract started.

Yeah but she never got a phone? Are you telling me I should got her some expensive ass phone and sold it for some cash before she starting using the iPhone on the line? I mean she never got any discounts or phones from AT&T? Thought everyone got at least one phone discount.

Hate to tell you man but 16GB Black 3Gs are selling on Ebay $400 and up. Why? NO CONTRACT. Without a contract they'd retail for $400 and up. People from overseas like China will pay a premium for unlocked/JB phones because they don't have a carrier 'officially' supporting the phones. The market is still there. If I were you I'd renig on the $150 deal and sell on ebay.

Umm... unlock it and jailbreak it before you sell it...
If I knew how, I probably would.

But I think what I am going to do is upgrade my sons line, who is due, to the 3GS, for $199 (16 GIG). Then he will have a iPhone data plan, just like me, right?

Then me and him can just swap phones and SIM Cards so I have the 3GS and he has the regular 3G.

Right? :D
 
I sold 3 iPhone 3G's last night for $425 each... none of them were unlocked or jailbroke.
