iPhone 4S raise to speak for Siri not working?

Is anybody noticing that raise to speak for Siri not working on their devices.

I have it checked in the settings and it was initially working so not sure what the problem is.

I've done restores and that fixes the issues temporarily but they it reoccurs shortly after.

Also, has anyone noticed that the volume buttons when pressed don't actually change the volume sound as the popup animation that comes up doesn't change as it should and the volume tab on the multitasking bar acts as if your using an external speaker?
