so I’m used to tech having a glitch here or there but since iOS 10 all my phones have had software glitches... but this time I dropped a bunch of money for this Xs Max... so I get worried when something weird happens. If anyone can help me that’d be brilliant.

So I’m not a serial returner, so I’m hoping someone can help me see if my problem is just software being dumb or if my phone flashing to a black screen then back to normal is a concern, or if it’s restarted once by itself, and can get stuck occasionally on an Apple or 3rd party app (when I need to switch to look at something else while calling.)...Is any of this an indication of Hardware.

I’m super paranoid as this is the new exchanged phone... my last Xs Max had broken speakers and a malfunctioning touch screen.
*i mean my luck can’t be that bad right

I hope it’s normal and I’m just crazy.

Not normal. Try restoring it, at setting up as new, not from back up. Apple will tell you to do that first thing. If that doesn’t solve it, call Apple and get it exchanged.

Of the millions of new iPhones sold since launch, lots of people have had to return them due to defects. Exactly how many we'll never know. But there's obviously more than a few defective iPhones in the pipeline and on the shelves at Apple Stores. That being the case, the odds of returning a lemon and getting another new lemon as a replacement are not minuscule. I'd say at least 1:10. But that's just my pessimistic guess based on the threads here in this forum.

If you had to return a phone 5 times to get a good one I wouldn't be surprised at all. Neither would most people here.

You can’t use the threads on a forum to determine this. Of course your going to read about a bunch of problems here. It’s a Internet forum. People are going to come here to complain about the issues. Those who have flawless phones; aren’t going to come here to complain, because they have no reason too. For every 1 person here complaining of an issue, I’m sure there’s a ton who have no issues.

So I contacted Apple yesterday morning and told them the issues I was having and what T-mobile told me to do, the rep set-up an appointment for me and they swapped out my glitchy iPhone Xs without any issues. All the AppleCare and Apple Store employees were amazing and so cool. I actually didn’t expect them to swap it, so I’d have just gone back to T-Mobile, but Apple stepped up here and did a great thing for me when in reality T-Mobile probably should have taken the issue, but I’m not complaining or anything, my new phone is awesome. Thanks Apple!
*knock on wood that it stays awesome. lol

The biggest problem I have had with my XS Max is that the top loudspeaker quits working after a while for music/video playback.

Apple really needs to fix this problem.

So update... 5-days later and my replacement iPhone xs max is freezing and going black and shutting off. I am using it lightly and the app it first froze and glitched on was Instagram. But it froze using photos, went black for 5-7 seconds then restarted.
I don’t know what to do. I don’t want to go back to Apple, but this is quite odd... apparently I’m not the only one this is issue. ?. :/

Ugggghhhh!
