i have an 8gb first gen iphone i bought of a lady who had it activated on at&t. I then unlocked it with pwnage and use it on tmobile. It has applecare until 2010. its in great condition overall except the back has scratches on it, it has been dropped a few times.

I was wondering if something were to go wrong with my iphone and i sent it in would they turn down my applecare on the iphone sense its been dropped and unlocked, is there not a way to restore the iphone were you cant tell that its been unlocked with pwnage.
 
I'm pretty sure the warranty for the iPhone (at least the original iPhone) covers the iPhone regardless of AT&T account status. I don't believe the warranty on the original iPhone mentions that in order to receive warranty work the phone has to be activated with a valid AT&T account.

Someone correct me if I'm wrong.
 
I haven't really read the iPhone warranty and AppleCare terms and conditions 100% of the way through, but geniuses just like any technician offering free service is told to look for things that could deny coverage.

Aftermarket programming is a very easy reason for warranty coverage to be denied I think the only way you could get by is if the phone doesn't boot at all and shows no signs of jailbreaking. But even though, if they give you another one, I hope for your sake they let you take it home to activate.
