iPod Ipod did NOT back up my data before updating

How is it that you are all so complacent about Apple's control over your personal property?

I purchased this device, therefore it is mine, and I can put whatever I wish onto it.
Where in the manual does it say that Apple has the authority to erase all of my information if I upgrade the software?

I had a year's worth of biomedical lectures, tons of photo research, and surgical instruction videos on my Ipod. I clicked "Backup" before updating it to the new software. Now, it is all gone, and when I right-click and restore from backup, it doesn't do anything of the kind.

Has anyone started a class action lawsuit yet over Apple's intrusion of privacy?
What software company in their right mind erases all of a client's data from a simple upgrade?

Huh? There's no invasion of privacy if they're not looking at your data!
And to be perfectly blunt; you're the one who performed the update. That said, just about every large company I know of that deals with personal device repair/upgrade specifically states that data is expected to be erased. Nokia specifically erase and reset everything, as it is considered possible the user data is a potential source of a problem.

Finally; regarding the backup; would you not have sync'd the ipod? In normal use, that's how the media files are usually preserved.

Using the iPod as a source backup for any sort of data is a terrible idea on your part. I would not trust my iPod with my backups. Now when you do an update to your iPod, did you bother to read the TOS that comes with it? You know, the one you have to read and click on the box that says, "I have read and agree to the terms within this agreement", that agreement does mention data loss.

What happened to people blaming themselves, it's as if no one can make mistakes anymore, they have to blame someone else for their mistakes.

If you did not backup for a whole year, then obviously the content you downloaded (and don't have the original) aren't important to you.
