I'm looking to resell my laptop in the near future and would like to set it up cleanly by formatting the drive and having Lion pre-installed for the future owner.

In SL and Leopard you can format the drive during the installer and when the account setup welcome screen comes on quit out to allow the future owner to set up their own computer from scratch. Is there any way to do this in Lion?

Based on the last preview (DP4), yes there is and you can do the same than on Snow Leopard.
 
If I were to install it onto the recovery partition and then do a format and install will the computer have a record of my iTunes account?
 
How would that work - legally - to resell your computer with Lion on it, that you purchased? I'm just curious about this new "no physical media" thing, and how it works in situations like this!

I really don't think it's a problem, I'm just wondering how we can sell a computer without being able to provide an OS install disk, when there is no disk with the OS in the first place!

That's definitely something Apple needs to address when Lion is released. And even if there are no legal problems doing this, I think the other poster's question about whether a Lion install is going to keep any information about your iTunes account is valid as well.
