Thanks everyone. I got a stock 2.66 Mac Pro. Funny how the 'Apple certified' heat spreaders look different but the 'apple qualified' ones look the same.

Upon examining my Mac Pro (refurbished) I noticed some scratches near the top of the door. Apple said they would give me $75 or exchange it for another, which would take about 2 weeks :( not sure what I'm gonna do.

After 2 hours of talking to 4 different people at Apple I got a supervisor to overnight me Logic Express for $50 (with free shipping) to compensate for the scratches :D (Having the Pro Care appontment on Saturday gave me enough leverage make the deal). I can live with a few scratches for $250!
