Issue with trash not emptying

When I go to empty my trash, the icon still appears full and when I ope trash the files are all here. However they are like.. broken. If I drag them out it says they don't exist. It's as though it is empty, but showing full?

Have you tried restarting your Mac with reopen windows when logging back in disabled/unchecked? Are they still visible after that?
