Well if your going by the picture then it's not because there is no external volume control. Seems like 1st Gen.
 
It's a first gen. I don't think there ARE second gen refurbs yet.

Ways to tell between the two gens:

- First gen comes in a black cardboard box, the second gen comes with a plastic case (like the iPod nano packaging).
- First gen has a black aluminum bezel around the screen, the second gen's metal backplate curves around to form the bezel (it looks a lot like the iPhone from the front as a result).
- The Wi Fi receiver on the first gen is in the upper left hand corner and is more of a square shape. On the second gen it's more of an oval shape and moved down from the corner slightly.
- The second gen has music controls. The first gen does not.
- The first gen has a much flatter back, the second gen is tapered (the middle is thicker, and gets thinner at the edges, like the iPhone 3G).

It wasn't released at the original launch of the iPod touch, it was added to the lineup in February this year. The second gen received absolutely no storage bumps.

That link you posted is definitely to a first gen.
 
If the OP looked at the brand new iPod touch's on the Apple Store, or even the proper iPod touch page on Apple's site, it would be clear it isn't a 2G.

it wasn't but the reason i asked the question is because apple obviously made a mistake earlier in the week because my brother ordered that ipod and it said second generation but when he received it, it was a first gen. thank you. the site has since been changed but i wouldn't post if it was useless.
